WARN ACT CLAIMS Information Page

This page will provide you with information regarding the class action settlement. Orders of the court, relevant information to class members, and selected documents will be posted periodically. Some versions of these documents will require the Adobe Acrobat Reader Plug-in which is available free of charge and may be obtained by clicking here.

The following document contains two orders. The first order approves the fee application of class counsel, and the second order approves the settlement. Arrangements are presently being made to forward checks to all class members pursuant to the terms of the settlement. However, the estate of Charter has requested that checks be forwarded to all class members without any deductions for applicable taxes. If this request is granted by the court, class members will receive checks, but will be responsible for the payment of any taxes due, and no deductions will be made by the estate. Each class member will receive an IRS form 1099 for the calendar year in which WARN disbursements are made:

The following document is the court ordered notice which describes essential terms of the settlement, and provides information regarding the class definition, the claims payment process, the manner for having bankruptcy court evaluation of contested claims, and other information.
